Abstract

BRITO, Miguel Nogueira de. Models of Emergency Powers in Constitutional Law. e-Pública [online]. 2020, vol.7, n.1, pp.06-26. ISSN 2183-184X.

The understanding of the emergency powers exercised in recent times requires a critical review of the available models of exceptional powers in democratic constitutional experiences. After reviewing these models critically, this text seeks to understand, in the light of such models, the recent evolution in Portugal since the declaration of a state of emergency by the President of the Republic according to article 19 of the Portuguese Constitution.

Keywords : States of exception; state of emergency; calamity; executive power; pandemic.
