Abstract

GOUVEIA, Paulo Pereira. The revision of the Code of Procedure in the Administrative Courts in regard of appeals. e-Pública [online]. 2019, vol.6, n.3, pp.71-86. ISSN 2183-184X.

Act of Parliament n. º 118/2019 revised the Portuguese Code of Procedure in the Administrative Courts. In this paper the subject is the appeals legal regime. The specificity of administrative litigation implies a different regime of appeals than that prevailing in civil proceedings. The 2019 review aimed to improve and clarify this specific regime, particularly in the context of pre-contractual litigation, standardization of case law and administrative arbitration. The changes made will have achieved its goals, albeit with less success in the arbitration provided in the Public Procurement Code.
