Abstract

APARICIO, Hugo. Civil Liability of the State for Judicial Error: The unwise consecration of article 13.º, n.º 2, of RCEEP. e-Pública [online]. 2019, vol.6, n.1, pp.123-140. ISSN 2183-184X.

This article is dedicated to the analysis of the civil liability of the State for judicial error and its respective constraints/requirements envisaged in article 13 of State's Civil Liability Regime. Target of a detailed examination will be the specific procedural requirement for the fulfillment of the responsibility for judicial error foreseen in article 13, n.º 2, in order to understand its merit and its validity in the Portuguese legal system.
