Abstract

Although less known, the influence of European Union law on public property rights of the Member States is quite real. In fact, such influence emerges in all aspects of the public goods management where Competition law, State aid law or Community freedoms have already profoundly altered the discretionary power of administrative decision-makers, forcing the legal systems to evolve. Apart from the public domain management, in which those effects are already noticeable, European Union law seems capable of triggering more intense conceptual changes while calling into question the perimeter, the structure and the very purpose of public appropriation.
