Abstract

The revision of administrative procedure which took place as a result of Decree-Law n.º 214-G/ 2015, 2 October, changes the regime of the extension of the effects of the judgment, introducing new prerequisites. The uniqueness of Article 161 of the Code of Procedure of the Administrative Courts derives from the fact that what is concerned is a regime of a substantive nature, with procedural protection, in the context of declaratory proceedings modelled on proceedings for the enforcement of judgments annulling administrative acts. The issues raised by the substantive and procedural pre-conditions, set forth in the provision, are numerous and complex. Among them are the effects of the judgments and the connection with the principles of res judicata, the case decided, the acceptance of the act and with the affected parties.
