Abstract

CALDEIRA, Marco. Public contracts susceptible to competition: the application of public procurement rules to Planning and Land Development Agreements. e-Pública [online]. 2015, vol.2, n.3, pp.272-286. ISSN 2183-184X.

The Decree-Law no. 214-G/2015, of 2 October, which altered the Code of Process in Administrative Courts, raises several questions regarding the application of the new procedural rules. Focusing on the claims regarding public procurement conflicts, this article analyses whether or not the claims filled after the Decree-Law no. 214-G/2015 entered in force are already subject to this new legal framework and, in such scenario, how does it affect the deadlines for the submission of claims that are still pending.

Keywords : ius superveniens; entry in force; pre-contractual litigation; revision on the Code of Process in Administrative Courts; deadlines for the submission of judicial claims.
