In order to point out the duties that stems from the fundamental right to good public administration and are imposed on Public Administration in its operation to the citizens, this study discusses about comprehension of mentioned right, analyzing its existence and structure in the Brazilian legal system, considering the meaning assigned to it by the European charter of fundamental rights. This study specifically analyzes, then, the mentioned duties, recognizing the State omissions that are derived from its non-compliance, to, finally, ponder about the objective state liability that stems from these omissions.
