Abstract

On the Portuguese constitution, the science concept is guaranteed, on terms of the article 42º, including not only the activity of creation, but also of investigation and theorization. For that it’s just necessary the presence of science’s characteristics as their won method and their won finalities. On terms of the 42º article, nº 2 is also guaranteed the result of all intellectual creations. Not only the science, as fundamental investigation, it’s protected, but also the technique, because, on the end off, the technique it’s a scientific practical investigation. The norm of article 42 º also protects the science teaching. The liberty of science it´s not just a defensive right but includes active measures of protection, a right to receive subventions and the scientist right to protect himself inside a due administrative organization and through a due administrative process of law.
