The authors reflect on the Portuguese punitive system, namely the goals of the penalties, which are repayment, general prevention and special prevention. They emphasise in particular penalties that restrict freedom, penalties of fine and penalties of substitution, analysing its advantages and inconveniences given the possibilities of the individual's social reintegration. Substitution penalties that prevent the individual from the contact with the correctional system and the interruption of social and professional relations are enhanced.
